1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of unlockdtc.ca, unlockbenefits.ca, and related websites and services (collectively, the "Services") operated by Unlock Benefits Inc. ("we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

If you purchase our Disability Tax Credit services, you will also be subject to our Service Agreement, which contains additional terms specific to that engagement.


2. About Unlock Benefits Inc.

Unlock Benefits Inc. is a Canadian federal corporation operating tax preparation and benefits optimization services. Our flagship service is the Disability Tax Credit application service operating under the name "unlock.dtc."

3. Description of Services

3.1 Free Resources

We provide free informational resources on our websites, including:

  • General information about the Disability Tax Credit and related Canadian benefits;
  • A free eligibility quiz that estimates whether you may qualify for the DTC;
  • Information about our paid services;
  • Educational content about disability benefits in Canada.

3.2 Paid Services

Our paid services include:

  • Disability Tax Credit application preparation and CRA submission;
  • Related services as they become available (Child Disability Benefit, RDSP setup, annual tax preparation, etc.)

Paid services are governed by a separate Service Agreement that you accept when purchasing.

3.3 Not Legal, Financial, or Medical Advice

The information on our websites is for general educational purposes only. It is not:

  • Legal advice;
  • Financial or investment advice;
  • Medical advice;
  • A substitute for consultation with a qualified professional in those fields.

If you need legal, financial, or medical advice, consult an appropriate licensed professional.


4. Eligibility to Use the Services

You must be:

  • At least 18 years of age, OR using the Services on behalf of a minor as a parent or legal guardian;
  • A Canadian resident OR acting on behalf of a Canadian resident.

If you are using the Services on behalf of another person, you confirm you have legal authority to do so.

Our paid services are currently available to residents of Canada outside the province of Quebec, and are offered in English only. We do not presently serve Quebec residents, as we do not yet offer services and documents in French as required under Quebec law.


5. Account Registration

5.1 Account Creation

Some features require creating an account. When you create an account, you agree to:

  • Provide accurate, complete information;
  • Keep your password secure;
  • Not share your account with others;
  • Notify us of any unauthorized use;
  • Be responsible for activity under your account.

5.2 Account Termination

We may suspend or terminate your account if:

  • You violate these Terms;
  • You provide false or misleading information;
  • We are required to do so by law;
  • We discontinue the Services.

You may close your account at any time by contacting hello@unlockdtc.ca.


6. Acceptable Use

You agree not to use the Services to:

  • Violate any law or regulation;
  • Infringe on intellectual property or privacy rights;
  • Submit false, misleading, or fraudulent information;
  • Attempt to gain unauthorized access to our systems;
  • Interfere with the operation of the Services;
  • Send spam, malware, or harmful content;
  • Harass, threaten, or harm others;
  • Impersonate any person or entity;
  • Scrape, copy, or systematically harvest content from the Services;
  • Use the Services for any commercial purpose other than as a customer (e.g., do not republish our content, do not use our services to provide DTC preparation to your own clients).

7. Eligibility Quiz Disclaimer

7.1 What the Quiz Is

The free eligibility quiz on our websites provides a general indication of whether you may qualify for the Disability Tax Credit. It uses your responses to common criteria to give a tier estimate (e.g., "high likelihood," "moderate likelihood," "low likelihood").

7.2 What the Quiz Is Not

The quiz is not:

  • A guarantee that CRA will approve or deny your application;
  • A formal eligibility determination under the Disability Tax Credit Promoters Restrictions Act (DTCPRA);
  • Legal or medical advice;
  • A substitute for professional review by our team or CRA's decision.

7.3 Quiz Results

Quiz results are estimates based on the information you provide. Actual eligibility is determined solely by CRA based on its assessment of Form T2201 (Disability Tax Credit Certificate) submitted by you and your medical practitioner.

7.4 No Service Relationship Created

Taking the quiz does not create a service relationship between you and Unlock Benefits Inc. A service relationship is established only when you purchase our services and accept our Service Agreement.


8. Intellectual Property

8.1 Our IP

All content on the Services, including text, graphics, logos, software, and design, is owned by or licensed to Unlock Benefits Inc. and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, modify, distribute, or create derivative works of our content;
  • Use our trademarks (including "Unlock Benefits," "unlock.dtc," "unlock.benefits," and related marks) without our written permission;
  • Reverse engineer or attempt to extract our source code or algorithms.

8.2 Your Content

You retain ownership of any content you submit to us (e.g., questionnaire responses, medical information). By submitting content, you grant us a limited license to use it solely for the purpose of providing the Services to you.

This license terminates when:

  • We delete the content under our Privacy Policy retention schedule;
  • You withdraw consent and request deletion;
  • The service relationship ends and the relevant retention period passes.

8.3 Feedback

If you provide feedback or suggestions about the Services, we may use that feedback without obligation to you.


9. Privacy

Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms by reference.

By using the Services, you consent to our collection and use of personal information as described in the Privacy Policy.


10. Third-Party Links and Services

The Services may contain links to third-party websites or services. We are not responsible for:

  • The content or operation of third-party sites;
  • The privacy practices of third parties;
  • Transactions or interactions you have with third parties.

Your use of third-party sites is at your own risk and subject to their terms and privacy policies.


11. Service Availability

11.1 No Guarantee of Availability

We strive to keep the Services available 24/7, but we don't guarantee uninterrupted access. The Services may be unavailable due to:

  • Scheduled maintenance;
  • Technical issues;
  • Force majeure events;
  • Discontinuation of features.

11.2 Changes to Services

We may modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice of significant changes that affect paying customers.

11.3 No Liability for Downtime

We are not liable for damages resulting from service unavailability, except where required by law.


12. Disclaimers

12.1 "As Is"

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

12.2 No Guarantee of Outcomes

We do not guarantee:

  • That you will qualify for the Disability Tax Credit;
  • That CRA will approve any specific application;
  • The amount of any refund or benefit you may receive;
  • Specific timelines for CRA processing.

12.3 Accuracy of Information

We strive to keep information on the Services accurate and up-to-date, but we don't guarantee accuracy. CRA rules and forms change; tax law evolves; the information we publish may become outdated.

Before relying on any information from the Services, verify with current CRA publications or a qualified professional.


13. Limitation of Liability

13.1 Limit

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Services is limited to the amount you have paid us in the 12 months preceding the claim, or CAD $200, whichever is greater.

13.2 Excluded Damages

We are not liable for indirect, incidental, consequential, special, or punitive damages.

13.3 Exceptions

Nothing in this Section limits liability for:

  • Fraud or fraudulent misrepresentation;
  • Gross negligence;
  • Death or personal injury caused by negligence;
  • Any liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold harmless Unlock Benefits Inc. and our officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your violation of these Terms;
  • Your violation of any law or third-party rights;
  • False or misleading information you provide to us;
  • Your misuse of the Services.

This Section does not apply where applicable law prohibits indemnification clauses.


15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of British Columbia and federal laws of Canada applicable therein.

15.2 Disputes

If you have a dispute with us, you agree to first contact us at hello@unlockdtc.ca to attempt informal resolution. We will respond within 7 business days.

If informal resolution fails, disputes may be brought in the courts of British Columbia, except where applicable consumer protection legislation provides for jurisdiction in your province of residence.

15.3 Regulatory Complaints

Nothing in these Terms limits your right to file complaints with:

  • The Office of the Privacy Commissioner of Canada;
  • Provincial privacy commissioners;
  • The Canada Revenue Agency;
  • Consumer Protection BC or equivalent provincial bodies;
  • Other applicable regulatory authorities.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will:

  • Update the "Last updated" date at the top;
  • Notify users with active accounts by email;
  • Post a notice on our website for at least 30 days before changes take effect.

Your continued use of the Services after changes take effect constitutes acceptance.

If you don't agree with the changes, stop using the Services and close your account.


17. Termination

17.1 By You

You may stop using the Services at any time and close your account by contacting hello@unlockdtc.ca.

17.2 By Us

We may terminate or suspend your access to the Services if:

  • You violate these Terms;
  • You provide false information;
  • Required by law;
  • We discontinue the Services.

17.3 Effect of Termination

Sections that by their nature should survive termination (e.g., intellectual property, limitations of liability, indemnification, governing law) survive.


18. Entire Agreement

These Terms, together with the Privacy Policy and (for paying customers) the Service Agreement and Refund Policy, constitute the entire agreement between you and Unlock Benefits Inc.


19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
